                                ORDINANCE NO. 9701
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, THE ZONING ORDINANCE, SO AS TO
                   TO AMEND CERTAIN SECTIONS RELATIVE TO
                   PERMITTED USES IN THE R-4 SPECIAL ZONE.
                  
                            __________________________
        
              	   WHEREAS, it has been determined that there is a need
         to amend several sections to the Chattanooga Zoning Ordinance,
         Ordinance No. 6958, as amended so as to expand the permitted
         uses in the R-4 Special Zone; and
              	   WHEREAS, such expanded uses should include certain
         light retail uses as would be appropriate in this zone; and
              	   WHEREAS, the expanded uses should be regulated and
         controlled by the Board of Appeals for Variances and Special
         Permits through the Special Permit process;
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, 
the
         Zoning Ordinance, be and the same is hereby amended as follows:
              	   SECTION 1.	  That Article V, Section 401 be amended
         by adding new subsections (27) and (28) as follows:
        
                   (27)	Museums and art galleries with retail
                        sales as an accessory on-site use, except
                        that such accessory use shall require a
                        special permit under the terms of Article
                        VIII.
                  
                   (28)	Gift shops, except that such use shall
                        require a special permit under the terms
                        of Article VIII.
                  
         	   SECTION 2.	  That Article VIII, Section 107, be
         amended by adding new subsections (17) and (18) as follows:
                   (17)	Museums and art galleries with retail
                        sales as an accessory on-site use in the
                        R-4 Special Zone.
                  
                   (18)	Gift shops in the R-4 Special Zone.
        
         	   SECTION 3.	  BE IT FURTHER ORDAINED that this
         Ordinance shall take effect two weeks from and after its 
passage
         as required by law.
